GENERAL TERMS AND CONDITIONS OF THE "LA FÉE MARABOUTÉE" LOYALTY PROGRAM
LA FÉE, a simplified joint-stock company with a capital of 4,498,200 euros, whose registered office is located in Mably (42300) 3 Chemin de la Chapelle, registered with the ROANNE trade and companies register under number 487 641 664, operating under the trade name and brand "La Fée Maraboutée", offers its customers (hereinafter "the Customers") a loyalty program automatically activated after a purchase, with no additional membership fees.
- GENERAL PROVISIONS
These general conditions define the terms of the Loyalty program allowing Customers to benefit from advantages based on the amount of their purchases, whether orders in stores under the “La Fée Maraboutée” brand (hereinafter “the Store(s) ”) or on the site https://lafeemaraboutee.fr/ (hereinafter “the Site”).
Purchases made on the Site with delivery outside mainland France, on marketplaces, on the “Place des Tendances” site, any other wholesale or corners are not taken into account.LA FÉE reserves the right to modify these general conditions at any time to adapt them to changes in the Loyalty program and/or legislative or regulatory developments.
The version binding on the Customer is the one on the Site at the time of using the Site or making a purchase in Store.
These general conditions are also available in Store to any Customer who requests them.
By agreeing to benefit from the Loyalty program, the Customer acknowledges having read these general conditions available on the Site at the following link www.lafeemaraboutee.fr/cgu-programme-fidelite and in Store upon request.
LA FÉE reserves the right to suspend or terminate the Loyalty program provided that Customers have been informed by email at least one month in advance.
No modification, suspension, or cancellation of the Loyalty program will entitle Customers to compensation.
In the event of permanent termination of the Loyalty program, Customers will be able to benefit from the advantages their status entitles them to within one (1) month from the notification made by LA FÉE.

- ENROLLMENT IN THE PROGRAM
The Loyalty program applies automatically, with no action required, to any identified Customer who has made at least one purchase in Store or on the Site since the 11st January 2020.
At the program launch, existing and identified Customers are informed by sending an email.
Access to the Loyalty program is however reserved for Customers of legal age who have the legal capacity to contract or have parental authorization.
For Customers who have placed an order on the Website, recognition and membership are automatic with the Customer's email address.
For Customers making a purchase in-store, they will be asked for their last name, first name, postal code, email address, and phone numbers so they can be identified and thus benefit from the Loyalty program, which they can access at any time in their client area on the Website.
Any new Customer joining the Loyalty program will be informed by email and, if applicable, by SMS if her phone number has been provided.
Membership will only be effective after a 30 calendar day period following the in-store purchase or the Customer's receipt of the order placed on the Website, provided the Customer has not returned her purchase within this period.
30 calendar days after each new purchase, the Customer will receive an email specifying her new points balance and status.
The status the Customer holds and her points balance are also accessible at any time in her Client area on the Website.
Joining the Loyalty program does not require a physical card, as it is dematerialized.
Thus, every Customer is recognized and automatically benefits from the advantages linked to her status with her email address.
The benefit of the Loyalty program is valid indefinitely for any purchase in stores in Metropolitan France and on the Website for deliveries in Metropolitan France.
The benefit of the Loyalty program is strictly personal and cannot under any circumstances be transferred, sold, or used for purposes other than those defined by LA FÉE in these general conditions.
Employees of LA FÉE cannot benefit from it.
- LOYALTY PROGRAM TERMS AND CONDITIONS
The Loyalty program includes three statuses, each granting access to specific benefits valid in Metropolitan France (discounts, services, gifts, experiences).
ONE (1) euro of purchase entitles you to 1 loyalty POINT.
- The FEE status is granted to each Customer who has earned between 0 and 299 points during the previous calendar year and the current year;
- The MUSE status is granted to each Customer who has earned between 300 and 799 points during the previous calendar year and the current year;
- The DEESSE status is granted to each Customer who has earned at least 800 points during the previous calendar year and the current year.
Each purchase is counted after a period of 30 calendar days from the purchase date (whether it is an in-store or online purchase, regardless of the withdrawal period to which the Customer is entitled under legal provisions).
In case of a return within this 30 calendar day period, the initial purchase is not counted.
Changing from one status to another can occur during the calendar year.
Once obtained, the new status is maintained throughout the current calendar year.
On the first of January each year, the Customer's status is recalculated based on the amount of her purchases made during the past year. The Customer retains the status obtained during the current year, except for an upgrade to a higher status (but cannot drop to a lower status before the 11st January of the following year).
- THE BENEFITS OF THE LOYALTY PROGRAM
Each status entitles you to benefits starting from the month following the month in which the status change took place, in accordance with the above conditions (see 3 supra).

The aforementioned benefits cannot be exchanged, compensated, or refunded in cash.
LA FÉE reserves the right to modify without notice the nature and scope of the Loyalty program benefits as well as the conditions for obtaining statuses, usage terms, and validity of the program without prior notice.

In case of dispute regarding the accumulated amount, only the information contained in the database of the company LA FÉE will be considered valid.
- LIABILITY
The Customer remains solely responsible for the use made of the benefits granted to her.
LA FÉE MARABOUTÉE will only be liable for direct and foreseeable material damages resulting exclusively from a willful breach of its contractual obligations.
LA FÉE MARABOUTÉE cannot be held responsible for any event not attributable to it, notably in case of misrouting of mail, malfunctioning of telephone lines, unavailability of the Site, technical failure, interruption of telephone communications, Internet network malfunctions making the execution of the Loyalty program impossible, or any other problem related to communication networks, servers, Internet service providers, computer equipment or software, loss of any data, consequences of any virus, anomaly, technical, hardware or software failure of any kind that damaged a Customer's system.
LA FÉE MARABOUTÉE disclaims all liability for direct or indirect consequences of any anomalies and malfunctions of the Loyalty program, whatever their causes.
- WITHDRAWAL FROM THE LOYALTY PROGRAM
Any breach of these general conditions, any abusive or fraudulent use of the Loyalty program, or any behavior likely to harm LA FÉE MARABOUTÉE or its reputation will automatically result in the immediate removal of the Customer's benefit from the Loyalty program and the cancellation of all advantages she may have claimed, without any compensation.
- PERSONAL DATA
The Customer guarantees the truthfulness and accuracy of the information provided.
The Customer's personal data collected for the implementation of the Loyalty program are processed in accordance with LA FÉE MARABOUTÉE's privacy policy accessible at the following link: https://lafeemaraboutee.fr/pages/politique-de-confidentialite
They are necessary for managing the commercial relationship and benefiting from the Loyalty program for the Customer.
Without providing this data (email address, last name, first name, and postal code), the Customer will not be able to benefit from the Loyalty program.
In accordance with Regulation (EU) 2016/679 dated April 27, 2016, relating to the protection of personal data, each Customer has, at any time, the right to access information concerning her, the right to have it corrected or completed if it is inaccurate or incomplete, the right to object to its transmission to third parties, the right to object free of charge to its use for sending commercial solicitations, and more generally, the right to object to any form of processing.
To do so, she simply needs to make a written request specifying her contact details and sending a copy of her identity card to the following email address:

- MISCELLANEOUS
9.1. Nullity
In the event that one of the clauses of these general conditions is declared null or void due to a change in legislation, regulation, or a court decision, this shall in no way affect the validity of the other clauses and the respect of these general conditions, unless the clause declared null or void is essential, alters the interdependence of certain provisions, or changes the overall balance of these general conditions.
If applicable, the disputed clause will be removed and replaced by a lawful clause.
9.2. Notifications
Communications between LA FÉE and the Customer are mainly conducted electronically, which is accepted by the Customer. Thus, the Customer must monitor her email and notifications received and respond when necessary.
- APPLICABLE LAW – LANGUAGE
These general conditions and the resulting operations are subject to French law, subject to the consumer legislation in force in the Customer's country of residence.
The language of these general conditions is French. In the event they are translated into one or more foreign languages, only the French text shall prevail in case of dispute.
- DISPUTES
11.1. Access to courts
Any dispute arising from the validity, interpretation, execution, termination of these general conditions, and more generally from any kind of relationship between LA FÉE and the Customer, shall be submitted to the competent French courts under common law conditions, except for mandatory or public order legal provisions to the contrary.
11.2. Mediation
LA FÉE and the Customer will strive to amicably resolve any difficulties that may arise in the application of these terms.
If no satisfactory response is received or if there is no response within 60 days, the Customer is informed that she may, in any case, resort free of charge to mediation with the designated Mediator, namely:
