GENERAL CONDITIONS “LA FÉE MARABOUTÉE” LOYALTY PROGRAM
LA FEE, simplified joint stock company with capital of 4,498,200 euros, whose head office is at Mably (42300) 3 Chemin de la Chapelle, registered in the ROANNE trade and companies register under number 487 641 664, operator under the commercial name and brand “La Féé Maraboutée” offers its customers (hereinafter “the Customers”) a loyalty program triggered automatically after a purchase, said program not being subject to any payment fees. additional membership.
- DISPOSITIONS GENERALES
These general conditions define the conditions of the Loyalty program allowing Customers to benefit from advantages depending on the amount of their purchases, whether they are orders in store under the brand “La Féé Maraboutée” (hereinafter “the( s) Store(s) ") or on the site https://lafeemaraboutee.fr/ (hereinafter "the Site ").
Purchases made on marketplaces, on the “Place des Tendances” website, any other wholesale or corners are not taken into account.
LA FEE reserves the right to modify these general conditions at any time in order to adapt them to changes in the Loyalty program and/or legislative or regulatory developments.
The version enforceable against the Customer is that appearing on the Site at the time of use of the Site or purchase in the Store.
These general conditions are also accessible in the Store to any Customer who requests them.
By agreeing to benefit from the Loyalty program, the Customer acknowledges having read these general conditions available on the Site under the following link www.lafeemaraboutee.fr/cgu-programme-fidelite and in the Store on request.
LA FEE reserves the right to suspend or terminate the Loyalty program subject to having previously informed Customers by email within one month.
No modification, suspension or deletion of the Loyalty program will entitle Customers to compensation.
In the event of permanent termination of the Loyalty program, Customers will be able to benefit from the advantages to which their status entitles them within one (1) month from the information provided to them by LA FEE.

- MEMBERSHIP OF THE PROGRAM
The Loyalty program applies automatically, without any action being necessary, to any identified Customer who has made at least one purchase in a Store or on the Site since 1is January 2020.
When the program is launched, existing and identified Customers are informed by sending an email.
Access to the Loyalty program is however reserved for adult Customers with the legal capacity to enter into a contract or who have parental authorization.
For Customers who have placed an order on the Site, recognition and membership are automatic with the Customer's email address.
For Customers making a purchase in Store, they will be asked for their last name, first name, postal code and email address and telephone numbers so that they can be identified and thus benefit from the Loyalty program which they can find at any time in their customer area on the Site.
Any new Customer joining the Loyalty program will be informed by email and, where applicable, by SMS if their telephone details are communicated.
Membership will only be effective after a period of 30 calendar days after the purchase in the Store or receipt, by the Customer, of the order placed on the Site, provided that the Customer has not returned the item. its purchase within this period.
30 calendar days after each new purchase, the Customer will receive an email specifying her new points balance and status.
The status enjoyed by the Customer and her points balance are also accessible at any time in her Customer area on the Site.
Membership in the Loyalty program does not require any physical card, it being dematerialized.
Thus, any Customer is recognized and automatically benefits from the advantages linked to her status with her email address.
The benefit of the Loyalty program is valid unlimitedly for any purchase in a Store in Metropolitan FRANCE, Corsica, Spain and Belgium and on the Site (it being specified here that there may be an extension of the benefit of the program for purchases made on e-shops to be created internationally).
The benefit of the Loyalty program is strictly personal and cannot under any circumstances be transferred, sold or used for purposes other than those defined by LA FEE in these general conditions.
LA FEE employees cannot benefit from it.
- THE CONDITIONS OF THE LOYALTY PROGRAM
The Loyalty program has three statuses which each allow access to specific advantages (discounts, services, gifts, experiences).
ONE (1) euro purchase entitles you to 1 loyalty POINT.
- FEE status benefits each Client who has acquired between 0 and 299 points over the previous calendar year and the current year;
- MUSE status benefits each Customer who has acquired between 300 and 799 points over the previous calendar year and the current year;
- DEESSE status benefits each Client who has acquired at least 800 points over the previous calendar year and the current year.
Each purchase is recorded at the end of a period of 30 calendar days from the purchase (whether it is a purchase in-Store or on-Site, notwithstanding the withdrawal period enjoyed by the Customer in accordance with the legal dispositions).
In the event of a return within this 30 calendar day period, the purchase initially made is not recorded.
The transition from one status to another can be made during the calendar year.
Once obtained, the new status is maintained during the current calendar year.
On January 1 of each year, the Customer's status is recalculated based on the amount of her purchases made over the past year. The Client retains the status obtained during the current year, unless she moves to a higher status (but cannot go down to a lower status before 1is January of the following year).
- THE ADVANTAGES OF THE LOYALTY PROGRAM
Each status gives the right to benefits from the month following the month during which the change of status took place in application of the aforementioned conditions (see 3 supra).

LA FEE reserves the right to modify without notice the nature and extent of the advantages of the Loyalty program as well as the conditions for obtaining the statuses, terms of use and validity of the program without notice.

In the event of a dispute relating to the cumulative amount, only the information contained in the LA FEE company database will be authentic.
- RESPONSIBILITY
The Client remains solely responsible for the use made of the benefits allocated to her.
LA FEE will be liable only for direct and foreseeable material damage resulting exclusively from a willful failure to fulfill its contractual obligations.
LA FEE cannot be held responsible for any fact which is not attributable to it, in particular in the event of poor delivery of mail, malfunction of telephone lines, unavailability of the Site, technical failure, interruption of communications telephone calls, malfunctions of the Internet network making it impossible to execute the Loyalty program or any other problem linked to communication networks, servers, Internet service providers, computer equipment or software, loss of any data, consequences of any virus, anomaly, technical, hardware or software failure of any nature that has damaged a Customer's system.
LA FEE disclaims all liability for the direct or indirect consequences of possible anomalies and malfunctions of the Loyalty program, whatever their causes.
- WITHDRAWAL FROM THE LOYALTY PROGRAM
Any breach of these general conditions, any abusive or fraudulent use of the Loyalty program or any behavior likely to harm LA FEE or its reputation will automatically result in the immediate removal of the benefit of the Customer's Loyalty program and the cancellation of the program. all the advantages to which she could have been entitled, without compensation of any kind.
- PERSONAL DATA
The Client guarantees the veracity and accuracy of the information provided.
The Customer's personal data collected for the implementation of the Loyalty program are processed in accordance with LA FEE's confidentiality policy accessible under the following link: https://lafeemaraboutee.fr/pages/politique-de-confidentialite
They are necessary for the management of the commercial relationship and for the benefit of the Loyalty program for the benefit of the Customer.
Without communication of this data (email address first name, last name, and postal code), the Customer will not be able to benefit from the Loyalty program.

9.1. Nullity
In the event that one of the clauses of these general conditions is declared null or void by a change in legislation, regulations or by a court decision, this will in no way affect the validity of the other clauses and compliance of these general conditions, unless the clause declared null or void is of an essential nature, modifies the interdependence of certain stipulations or modifies the general scheme of these general conditions.
If applicable, the disputed clause will be deleted and replaced by a lawful clause.
9.2. Notifications
Communications between LA FEE and the Client are mainly carried out through electronic communications, which is accepted by the Client. Therefore, the Customer must monitor her email and the notifications she receives and respond to them, if necessary.
- APPLICABLE LAW – LANGUAGE
These general conditions and resulting operations are subject to French law subject to consumer legislation in force in the Customer's country of residence.
The language of these general conditions is French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.
- DISPUTES
11.1. Access to courts
Any dispute arising from the validity, interpretation, execution, termination of these general conditions, and more generally from relations of all kinds between LA FEE and the Client, will be submitted to the competent French courts under the conditions of common law, unless mandatory legal or public policy provisions to the contrary apply.
11.2. Mediation
LA FEE and the Client will endeavor to resolve amicably any difficulties that may arise in the application of these conditions.
In the absence of a satisfactory response or in the absence of a response within 60 days, the Client is informed that she can, in any case, resort to free mediation with the designated Mediator service, namely:
